Reuse of photos, research data and the API service

1.Reuse of photos and research data

KIK-IRPA makes its photos and research data available for reuse as openly as possible. In doing so, it respects the rights of third parties.

KIK-IRPA has made every effort to comply with its legal obligations under intellectual property and copyright law. Where a rights holder could not be identified despite these efforts, the material is still made available on BALaT. Anyone wishing to assert their rights is invited to contact us at balat@kikirpa.be

The standard license: CC BY 4.0

By default, photos and research data produced by KIK-IRPA are made available under the Creative Commons Attribution 4.0 International license (CC BY 4.0). You are free to share and adapt the material, including for commercial purposes, provided that it is correctly attributed to KIK-IRPA. In practice:

  • Every item on BALaT has a persistent identifier, called a handle, that always resolves to the same record through https://hdl.handle.net. It takes the form https://hdl.handle.net/20.500.14037/photo.x109975, where the final part identifies the item.
  • For each record, a ready-to-use citation is shown in a citation block, and the applicable license and copyright information in a separate copyright block. When an item is reused on another website, we ask that its citation be made clickable and linked to its handle, so that the reference remains stable over time.

  • Furthermore, when photos are reused in publications or on the web, we ask that the credit line be included correctly in the caption. The credit line is shown on the photos and in the photo metadata, and usually has the form: © KIK-IRPA, Brussels (Belgium), cliché 11025404

When CC BY 4.0 does not apply

CC BY 4.0 is the default license, but it does not apply to every item:

  • Some photos depict works that are still protected by copyright and are therefore subject to different conditions.
  • Certain photos and research data may be subject to legal, legislative or contractual restrictions, or may be withheld due to legitimate commercial interests.
  • Other material, including items covered by agreements or collaborations with partner institutions, remains available under CC BY 4.0, but attribution must be made to the rights holder rather than to KIK-IRPA.
  • Some research datasets are temporarily unavailable. For example, datasets obtained on objects from private collections require the owner's prior consent, and datasets that are still being processed or under embargo are not yet released.

Always follow the license, citation and rights information shown for the individual item.

Photos of copyright-protected works

For photos, the CC BY 4.0 license covers only the reproduction of the photograph itself, not any copyright on the work shown in it. When a photo depicts a work that is still protected by copyright, such as a modern painting or sculpture whose creator died less than 70 years ago, you must obtain permission to reproduce that work separately and on your own initiative from its rights holder.

2.Reuse of the API service

KIK-IRPA offers an API service through which structured information can be retrieved directly and in real time from BALaT, including descriptive information, weblinks and thesauri. Access to the API is free of charge, and its reuse is subject to the same conditions as those set out above.

KIK-IRPA reserves the right to take legal action in cases of copyright infringement.
